ShakaPT Privacy Notice and OpenAI Sharing

PLEASE READ THIS NOTICE CAREFULLY, AS IT DETAILS HOW YOUR MEDICAL INFORMATION MAY BE USED, DISCLOSED, AND ACCESSED, INCLUDING ITS TRANSMISSION TO OPENAI’S CHATGPT.

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) mandates this Notice of Privacy Practices. It explains how ShakaPT collects, uses, and discloses your protected health information (PHI) for treatment, payment, and healthcare operations, as well as sharing with OpenAI’s ChatGPT. The notice also describes your rights and how to exercise them.

Protected Health Information (PHI) comprises demographic data that could identify you and pertains to your past, present, or future physical or mental health, related healthcare services, or healthcare service payments.

ShakaPT is dedicated to safeguarding your PHI, adhering to this Notice of Privacy Practices. We may modify the terms of this notice at any time, with any revised notice being effective for all PHI we maintain. You can request an updated copy of the notice by contacting us. By agreeing to ShakaPT’s Terms & Conditions, you acknowledge receiving this notice.

Uses and Disclosures of Protected Health Information:

1. With Your Written Consent: ShakaPT may use and disclose your PHI to provide healthcare services and facilitate payment for those services. Examples include obtaining approval for hospital stays and sharing relevant information with health plans for payment processing.

2. With Your Written Authorization: Other uses and disclosures of PHI will require your written authorization, which you can revoke in writing.

3. Agreement or Objection: ShakaPT may use or disclose your PHI to individuals involved in your healthcare unless you object. If you cannot object, we may disclose relevant information to family members, friends, or personal representatives based on our professional judgment. PHI may also be disclosed in emergencies or to authorized public or private entities for disaster relief efforts.

4. Permitted and Required Uses and Disclosures without Consent or Authorization: ShakaPT may use or disclose your PHI without consent or authorization in specific circumstances, such as communication barriers, disclosure required by law, public health activities, abuse or neglect reporting, legal or administrative proceedings, law enforcement, and more. 5. Sharing with OpenAI’s ChatGPT: ShakaPT will transmit client-submitted medical information to OpenAI’s ChatGPT for processing and analysis.

Your Rights:

You have various rights concerning your PHI, including the right to inspect and copy, request restrictions, request alternative communications, amend, and receive an accounting of disclosures. Electronic Communications:

You may communicate with ShakaPT electronically, but please note that email may not be entirely secure. By communicating via email, you acknowledge and accept the associated risks.

Complaints:

If you believe your privacy rights have been violated, you may file a complaint with ShakaPT’s Privacy Officer or the Secretary of Health and Human Services. We will not retaliate against you for filing a complaint.
